Terms & Conditions

Definitions 
 

  1. Capitalised terms in this agreement that are not otherwise defined have the meaning given to them in the agreement and  the meaning of the terms used in this agreement are set out below:

    • Nanny Boutique - a referral agency, which does not enter into contracts of employment with nannies.

    • Nanny or Nannies -  a nanny, carer or a babysitter that the Nanny Boutique refers to you. 

    • Services - the referral or provision of a Nanny for Nannies to you. 

    • Booking Fee - is the fee Nanny Boutique charges per booking and is set out on our website and/or will be provided to you separately.

    • Client/Family - you are the client. 

    • Placement Fee - is the fee Nanny Boutique charges for the placement of a permanent Nanny to your home and is set out on our website and/or will be provided to you separately. 

 

Criteria for Nannies
 

  1. Nanny Boutique will refer Nannies that have to meet a strict criteria, have sufficient experience caring for children, have a  valid working with children check, have a current first aid training and are legally eligible to work in Australia.

  2. Nannies are required to have a minimum of 2 contactable references with respect to their work. 

  3. Nanny Boutique will meet all Nannies face-to-face for evaluation. 

 

Nanny Boutique Process 
 

  1. When you contact Nanny Boutique to book a Nanny, you are required to provide us with information by completing the online form about the needs and requirements of your Family and required Nanny. 

  2. We will provide you with information about our Services and prospective Nannies  (either written or verbal) and suggest one or more Nannies that the Nanny Boutique considers will meet the needs of your Family.  

  3. In order to use the Services, you will be asked to agree to our terms and conditions which are contained in this agreement. 

  4. The Services that we provide include the referral of a casual  or permanent Nanny or Nannies to your Family in accordance with your Family’s needs.

  5. Nanny Boutique selects and refers Nannies to Clients for which a Booking fee is payable and is dependent upon the type of Nanny i.e. casual or permanent.  

  6. The Booking Fee applicable is set on our website and/or will be provided to you separately. These fees are subject to change without notice to you.

  7. If the Client seeks to engage a Nanny that has been referred by Nanny Boutique, the Clients enters into arrangements including payment with the Nanny directly. 

 

Casual Placements 

  1. Casual Placement(s) means a Nanny that is required on a temporary or casual basis which may be ongoing for a period of time. For example, every Thursday for a 3 month period or 4 hours Tuesday or a one-off Saturday night.

  2. For Casual Placements the Client will be charged a Booking Fee for every booking for which a Tax Invoice will be issued. The terms of payment will be provided in the Tax Invoice and all payments to Nanny Boutique are payable by electronic funds transfer. 

  3. Once Nanny Boutique provides the Services to you, the Nanny will contact you at least 24 hours before the Casual Placement begins and will make arrangements with you including dates, times, information about the Family, pets and hourly rate of pay. 

  4. You are responsible for paying a Nanny that has been placed with you. Nanny Boutique is not responsible for any compensation or public liability insurance cover for the Nannies.

  5. If the Client cancels a booking, no refund will be made  and for bookings that are cancelled after 4.30pm on a Friday for a Saturday/Sunday bookings then there will be an additional 2 hour cancellation fee.

  6. For ongoing Casual Placements the Booking Fee will be charged in advance on a weekly basis. If the Client cancels an ongoing Casual Placement, there will be no refund for the Booking Fee which has been charged in advance. 

  7. If the Nanny cancels, Nanny Boutique will endeavour to replace the Nanny and if Nanny Boutique is unable to replace the Nanny, a full refund will be made until a replacement can be found. 

 

 Permanent Placements

  1. Permanent Placements means a Nanny that is required for a permanent period of time. For example, a Nanny for Monday, Tuesday and Wednesday which is ongoing for an indefinite period of time.

  2. For Permanent Placements you will be charged a non refundable Booking Fee. These fees are subject to change without notice to you.

  3. Once Client has decided to employ a nanny, you will be charged a Placement Fee which must be paid before the commencement of the Nanny’s Permanent Placement. The Placement Fee is subject to change without notice to you.

  4. Payment for permanent placements to Nanny Boutique must be paid directly to Nanny Boutique. 25% non refundable deposit payable on verbal agreement between client and the nanny 75% to be paid on commencement of Nanny.

  5. You are responsible for paying a Nanny that has been placed with you. 

  6. Nanny Boutique is not responsible for any compensation or public liability insurance cover for the Nanny Boutique Nannies. 

  7. Nanny Boutique will provide a Tax Invoice to you for the Services and all payments to Nanny Boutique are payable by electronic funds transfer. The terms of payment will be provided in the Tax Invoice. 

  • Permanent afterschool are placement fee schedule 

  • We require a 25% upfront fee on verbal agreement between client and nanny and quarterly installments of the remainder of the fee.
     

Exclusivity of agreement
 

  1. If you engage the Nanny or Nannies through the referral of Nanny Boutique to work for you, all future or different bookings of the Nanny need to be made through Nanny Boutique.

 

General
 

  1. Nanny Boutique reserves the right to cancel any Client agreement immediately without notice for convenience or if any Nanny  is harmed, mistreated or found to be working in an unsafe environment.

  2. Nanny Boutique is a referral agency. This agreement does not create a partnership, joint venture, agency or employer- employee relationship between Nanny Boutique and Client. 

 

Liability

  1. Nanny Boutique is an agency not an employer, therefore accepts no liability or responsibility for any injury, accident, loss or misconduct sustained by the Nanny and the Client agrees to exclude the agency should any incident occur.

  2. Whilst Nanny Boutique endeavours to thoroughly background check Nannies in accordance with the criteria, it cannot guarantee that all information presented to us is correct.

 

Privacy

  1. All client information is confidential and not passed on to or sold to third parties.

 

Privacy Act 1988

Nanny Boutique covered by the Privacy Act 1988, which came into operation on 21st December 2001.

In accordance with our obligations under the Privacy act, this document advises you of the manner in which personal information is collected via this website and is handled by Nanny Boutique. 

Information collected 

When you browse Nanny Boutique's website, our internet service provider makes a record of your visit and logs the following information for statistical purposes:

 Your server address, your top level domain name (for example.com, .com.au, .gov etc) the pages you accused, the location from where you are browsing, the type of browsers you are using. Typically this data cannot in itself identify an individual and Nanny Boutique will not use this data to identify uses or their browser activity. 

However, in the unlucky event of an investigation, a law enforcement agency or other government agency may exercise its legal authority to inspect our internet service providers logs.

Personal information that Nanny Boutique does not collect via this website via online family and nanny forms. This information is regulated in an effort to serve our customers best and is  confidential and not passed on to or sold to third parties.
